With effect from 1 January 2022, an amendment to Act No. 300/2008 Coll., on Electronic Acts and Authorised Conversion of Documents significantly expands the use of private data messages. It will newly be possible to send these automatically all natural persons, enterprising natural persons and legal entities. Only non-enterprising individuals will then be able to switch-off the option of receiving these messages. Importantly, these private messages will also be subject to the same fiction of delivery as data messages from public bodies.
The aforementioned amendment also introduces automatic establishment of a data box for all business and non-business individuals with effect from 1 January 2023. In the case of later ones, though, it will only be after they have used a means of electronic identification (e.g. a bank identity) for the first time. However, non-business individuals, for whom a data box has been set up automatically, will be able to request that it be made inaccessible afterwards.
